Do sử dụng dây chuyền theo công nghệ mới trong sản xuất nên phân xưởng nơi chị K làm việc dôi dư một số lao động, trong đó có chị K. Chủ doanh nghiệp không thể sắp xếp chỗ làm mới cho chị K nên chị phải nghỉ việc. Trong trường hợp này, chị K có được bồi thường thiệt hại hay không?

 

Nếu chị K đã làm việc thường xuyên trong doanh nghiệp từ đủ 12 tháng trở lên thì trong trường hợp doanh nghiệp thay đổi công nghệ sản xuất, chị K bị mất việc làm và chủ doanh nghiệp không thể sắp xếp cho chị công việc mới thì chị K được nhận trợ cấp mất việc làm.

Mức trợ cấp mất việc làm mà người sử dụng lao động phải trả cho người lao động trong trường hợp này được tính như sau: cứ mỗi năm làm việc trả một tháng lương, nhưng thấp nhất cũng bằng hai tháng lương (khoản 1 Điều 17 Bộ luật Lao động).
